Terms and conditions for the Comm Express promotion and competition (“promotion”)

By participation in this promotion you accept these terms and conditions.

This competition shall commence on 01 October 2009 and ends at midnight on 31 December 2009.

To qualify as an entrant into this competition you must:

1 be a South African citizen or a permanent resident of the Republic of South Africa;
3.2 be an MTN Service Provider (Proprietary) Limited prepaid subscriber at the date of commencement of this competition, in your personal capacity;
3.3 be 18 years or older; and
3.4 have a valid South African driver’s licence.
3.5 You must purchase MTN airtime to the minimum value of R5.00 (Five rand) and sms your reference number printed on the voucher on which the airtime pin is printed to 32602 at a cost of R1.00 (One rand).

4 Entrants stand a chance of winning spot prizes in the form of prepaid airtime or monthly prizes in the form of Samsung products.

An entrant stands a chance to win a prize consisting of a vehicle, a VW Golf Tenaciti.

The prizes will not be transferrable or exchangeable for cash and any prize not taken up for any reason will be the subject of a separate draw and shall be allocated in terms of this competition.

The winner will be notified by telephone by Comm Express.

The Promoters, their directors, members, partners, employees, agents or consultants and their spouses, life partners, parents, children, siblings, business partners or associates are not eligible to participate in or enter this promotional competition.

No entry will be considered to be valid until a validation process has taken place. The prizes will only be handed to the prize winners upon valid and satisfactory proof of identification.

All information relating to this competition and communicated by email or on any promotional or advertising material forms part of the terms and conditions of entry.

The prize winners of the monthly prizes shall be chosen by means of a lucky draw on the 15th (fifteenth) day of every month. The winner of the VW Gold Tenaciti shall be chosen by mean of a lucky draw on 13 January 2010. All the prize winners shall be notified telephonically within a reasonable time after the lucky draw.

The decision of the Promoters will be final and binding on all aspects of this competition and no correspondence will be entered into.

14 The Promoters, their directors, members, partners, employees, agents, consultants, suppliers, contractors and sponsors assume no liability whatsoever for any direct or indirect loss or damage arising from a entrant's participation in this promotional competition or for any loss or damage, howsoever arising. The prize winners’ indemnify the Promoters and hold the Promoters harmless for any loss, damage, harm or injury which the prize winners’ may sustain as a result of any claim which may be made against it by any third party, whilst participating in this competition.

The Promoters will be entitled to publish the prize winner’s name and photographs in any advertising, promotional, print, point of sale or public relations material for a period of 12 (twelve) months from the date of the lucky draw.

If required by the Minister for Trade and Industry, the Lotteries Board or for whatever other reason, the Promoters shall have the right to terminate this competition with immediate effect and without notice of such termination.  In such event, all entrants hereby waive any rights, which they may have against the Promoters and hereby acknowledge that they will have no recourse or claim of any nature whatsoever against the Promoters, their directors, members, partners, employees, sponsors, agents or consultants.

17 The Promoters reserve the right to substitute any prize with another prize of similar commercial value.

The Promoters are not liable for the failure of any technical element relating to this competition that may result in an entry not being successfully submitted.
